By installing and using the UpsellCat application (“the App”), you agree to these Terms of Service. If you do not agree, please uninstall the App immediately.
UpsellCat is a Shopify application that enables merchants to create post-purchase and thank you page upsell offers. The App integrates with Shopify’s checkout extension APIs to display offers and modify orders when customers accept upsells.
You must have an active Shopify store and a valid Shopify plan that supports checkout extensions to use UpsellCat. You must be authorized to operate the store and accept these terms on its behalf.
Access to UpsellCat is managed through Shopify’s authentication system. You are responsible for maintaining the security of your Shopify account. We are not liable for unauthorized access resulting from compromised Shopify credentials.
UpsellCat offers a free tier and paid plans billed through Shopify’s billing system. Pricing is usage-based and determined by the upsell revenue your offers generate per billing cycle. Current pricing tiers are displayed on our website and within the app. We reserve the right to modify pricing with 30 days’ notice.
All charges are processed through Shopify’s billing infrastructure. Refunds follow Shopify’s standard app billing policies.
You agree to use UpsellCat in compliance with all applicable laws and Shopify’s terms of service. You may not:
All content, branding, code, and materials within UpsellCat are owned by us and protected by intellectual property laws. Your use of the App does not grant any ownership rights. You retain ownership of your store data, offer configurations, and content you create within the App.
By installing and using UpsellCat, you grant us permission to access, process, and store certain store data, configuration data, and order information as required to provide the service, maintain functionality, deliver support, and improve the application.
This access is limited to the minimum data necessary for operation of the service.
Your use of UpsellCat is also governed by our Privacy Policy. By using the App, you consent to the data practices described therein.
We strive to maintain high availability but do not guarantee uninterrupted service. UpsellCat depends on Shopify’s platform and APIs, which are outside our control. We are not liable for downtime caused by Shopify outages, scheduled maintenance, or force majeure events.
To the maximum extent permitted by law, UpsellCat and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising from your use of the App.
Our total liability for any claims related to the App shall not exceed the total fees you have paid to us in the 12 months preceding the claim.
You may terminate your use of UpsellCat at any time by uninstalling the App from your Shopify store. We may suspend or terminate your access if you violate these terms, with notice where reasonably possible. Upon termination, your data will be handled as described in our Privacy Policy.
We may update these terms from time to time. Material changes will be communicated through the app dashboard or via email. Continued use of the App after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
